1. Agreement to Terms

These Terms and Conditions (“Terms,” “T&C”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you,” “user,” “customer”), and Lorna Carmen McNeill, concerning your access to and use of the lornacarmenmcneill.com website, as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

By accessing the Site or purchasing any product or workshop, you acknowledge that you have read, understood, and agree to be bound by all of these T&Cs.
IF YOU DO NOT AGREE WITH ALL OF THESE T&CS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

2. Purchases and Payment

We accept the following forms of payment: PayPal.

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us. Prices for our products and workshops are subject to change without notice.

3. Terms Specific to Physical Products

3.1 Product Accuracy and Availability

We have made every effort to display as accurately as possible the colours, features, specifications, and details of the products available on the Site. However, we do not guarantee that the colours, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colours and details of the products. All products are subject to availability, and we cannot guarantee that items will be in stock.

3.2 Shipping and Risk of Loss

The risk of loss and title for all physical items purchased from the Site pass to you upon our delivery to the carrier. We are not responsible for packages that are lost or stolen after the carrier confirms delivery to the address provided by you. Shipping costs can be found here

3.3 Product Warranty

We offer no express or implied warranty on physical goods.

4. Terms Specific to Workshops and Services (Digital Content)

4.1 Intellectual Property Rights (IP)

All content provided as part of the workshop or service, including but not limited to videos, audio, documents, slides, workbooks, training methods, text, and graphics, is the proprietary property of Lorna Carmen McNeill and protected by copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and view the workshop content solely for your personal, non-commercial use.

YOU MAY NOT:

  • Record, copy, reproduce, distribute, or display any part of the workshop or its materials to any third party.

  • Resell, share, or transfer your access credentials to any other person.

  • Use the materials for any commercial purpose without express written consent from the Company.

4.2 Code of Conduct

We reserve the right to monitor all communications and content during live workshops. Any user who engages in behavior that is disruptive, abusive, harassing, or violates any applicable law may be immediately removed from the workshop and banned from future access without refund.

4.3 Results and Disclaimers

You acknowledge that the Company provides educational and informational resources. We make no guarantees or warranties concerning the level of success you may experience, and you accept the risk that results will differ for each individual. Any statements made regarding potential outcomes are estimates only. The success of any user is dependent on their background, dedication, desire, and motivation.

5. Refund and Cancellation Policy

Please review our separate Refund Policy for detailed information regarding returns of physical products and cancellation/refund terms for workshops.

  • Product Returns: Generally, returns are accepted within 14 days on unused physical products.

  • Workshop Cancellations: Generally, digital products and recorded content are non-refundable. Live workshop refunds are subject to a specific cutoff period CHANGE TO (e.g., 8 days before the event) as outlined in the separate policy.

6. Governing Law and Dispute Resolution

These Terms and Conditions and your use of the Site are governed by and construed in accordance with the laws of the State/Country of UK, without regard to its conflict of law principles.

Any dispute arising from these T&Cs shall be resolved in the courts located in Winchester.

7. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site or our offerings.

8. Other policies

  • Materials and Intellectual Property All materials, printed or otherwise, are included for personal use only.
  • Teaching or commercial reuse requires prior permission.
  • All teaching references and course notes remain the intellectual property of the course leader.
  • Attendance and refunds If payment is made for a full course, refunds cannot be given for missed lessons and are not transferable to another term or another course.
  • Materials and refreshments A basic set of some art materials will be available on certain days. You will be advised what additional materials you need to bring. Please bring your own refreshments.
  • Images and publicity Any images created during the workshop may be shared online anonymously to illustrate the course content. Please let us know if you would prefer this not to happen.
